**Terms of Use for Lethalsports/Emerge Brazilian Jiu Jitsu**
**1. Legal Entity and Contact Information**
Lethalsports/Emerge Brazilian Jiu Jitsu is a sole proprietorship located at Fascinatio Boulevard 1148, 2029 VA Capelle aan den IJssel, The Netherlands. You can contact us by phone at 06 19 22 24 79 or via email at emergebjj@gmail.com.
**2. Registration**
Membership registration is available from 18 years of age. Minors must register with the co-signature of a parent and/or legal guardian.
**3. Services**
Lethalsports/Emerge Brazilian Jiu Jitsu offers the following services:
- BJJ and Grappling group classes
- Personal training in various martial arts, including MMA, BJJ, kickboxing, and boxing
- Pads training
- BJJ classes for kids and toddlers
**4. Subscriptions and Rates**
**Adults (BJJ and Grappling group classes):**
- Monthly cancellable contract: €90 per month
- 3-month contract: €80 per month
- 1-year contract: €60 per month
- Stripe card: 10 classes for €120 (valid for 6 months)
- Single class: €15 per class
**Kids (BJJ for kids):**
- 1-year contract: €50 per month
- Monthly cancellable contract: €60 per month
**Toddlers (BJJ for toddlers):**
- Monthly cancellable contract: €30 per month
**Pads training:**
- Single class (30 minutes): €40 per class
- Package 1: 4 classes for €155
- Package 2: 8 classes for €300
- Package 3: 12 classes for €440
**Personal training:**
- Per session (60 minutes): €75
- Package 1: 4 sessions for €295
- Package 2: 8 sessions for €575
- Package 3: 12 sessions for €845
**5. Payment Terms**
Payments for services from Lethalsports/Emerge Brazilian Jiu Jitsu are processed via iDEAL on our website. For group classes, the payment process then switches to automatic debit. Payment for personal training and pads training is also accepted via iDEAL on our website.
Cash payments are possible but require prior contact with Lethalsports/Emerge Brazilian Jiu Jitsu.
In case of payment errors, it is the customer's responsibility to contact Lethalsports/Emerge Brazilian Jiu Jitsu. Refunds are processed by a collection agency that contacts the customer. Upon payment, the customer receives credits in the system for their account. These credits can be found on the Virtuagym mobile app. A login to Virtuagym is required to purchase services.
**6. Price Change**
Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to index prices for tuition fees and the annual contribution once a year. Price changes will be clearly communicated to members. Subscriptions or packages only change after the minimum term expires if there is a price change.
**7. Exams and Private Lessons**
The costs for exams and private lessons are not included in the tuition fees.
**8. Opening Hours**
Lethalsports/Emerge Brazilian Jiu Jitsu sets the opening hours as well as the class schedules, class locations, class forms, and rates. The venue is open 15 minutes before the start of the class. Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to change these times at any desired moment. Any changes will be announced at least 30 days before they take effect, except during (school) holidays. The member has the right to cancel the membership as of the date the change takes effect, **except in cases where the change concerns the class schedule. Changes to the class schedule do not entitle members to cancel their membership**.

**9. Absence**
In case of a member's absence from one of the classes or exams, the member remains liable for the full tuition fees or examination fees. There is no refund for tuition fees or subscription fees already paid.
**10. Non-timely Payment**
If the tuition fees or the annual contribution could not be debited from the bank or giro account specified by the member, Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to hand over the claim to a collection agency after Lethalsports/Emerge Brazilian Jiu Jitsu has formally requested the member to make payment. All costs of collection (both judicial and extrajudicial) are borne by the member.
**11. Liability**
Lethalsports/Emerge Brazilian Jiu Jitsu, its management, and its employees and instructors are not liable for any damage or injury suffered by the member or third parties during the classes or their stay in the gym. Damage to the training space caused by a member may possibly be paid for by the customer.
**12. Privacy Policy**
All information provided is used only by Lethalsports/Emerge Brazilian Jiu Jitsu to possibly approach or contact the customer for services or products that Lethalsports/Emerge Brazilian Jiu Jitsu offers. This information can be collected via the accounts or the trial lesson registration. The privacy policy of Lethalsports/Emerge Brazilian Jiu Jitsu can be read for more details on how personal information is collected, used, and secured.
**13. Not Responsible for Injuries and Terms and Conditions**
Lethalsports/Emerge Brazilian Jiu Jitsu is not responsible for injuries, accidents, property damage, death, or other unforeseen events that may arise from participation in activities at Lethalsports/Emerge Brazilian Jiu Jitsu. Members are advised to seek medical advice before participating in physically demanding activities.
**14. Hygiene Policy**
To ensure a clean and safe training environment for everyone, the following hygiene rules must be adhered to:
- All members are required to wear **clean clothes** at every training session.
- **No sharp or long nails** are allowed. Members must keep their nails short and filed.
- **Make-up and nail polish** are not allowed during training sessions.
- **No zippers** are allowed on clothing worn during training, as these can cause injury or damage.
- **No shoes or flip-flops** are allowed on the training mats. Members must be barefoot when training on the mats.
Failure to comply with these hygiene rules may result in damage to equipment, property, or injury to others. If any such damages occur due to non-compliance, **the costs will be borne by the customer**.
**15. Changes to the Terms of Use**
Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to make changes to these Terms of Use at any time. Amended terms become effective immediately after being posted on the Lethalsports/Emerge Brazilian Jiu Jitsu website. It is strongly recommended to regularly review the Terms of Use to stay informed of any updates. Users may be notified of changes through notifications on the Virtuagym mobile app, emails, or other communication methods used by Lethalsports/Emerge Brazilian Jiu Jitsu. By continuing to use the website after changes are made, users automatically accept the revised Terms of Use.
**16. Respect for the Training Environment**
At Lethalsports/Emerge Brazilian Jiu Jitsu, we strive for a respectful training environment. To ensure the safety and well-being of all our members, we ask all users to:
- Treat each other with respect, both inside and outside the training area.
- Follow the instructions of trainers meticulously.
- Respect safety rules and training protocols.
- Maintain personal hygiene, including wearing appropriate sportswear and ensuring clean sports equipment.
Failure to adhere to these guidelines may lead to warnings, suspension, or termination of membership.
**17. Appointments and Bookings**
- Users must book trainings at least 24 hours in advance.
- When canceling a training within 24 hours of the start, the credit for the training will be used, with the training being considered paid.
- Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to cancel trainings at any time.
- Users will be notified of cancellations through messages, at any time of the day.
**18. Changes in Terms at Registration**
Lethalsports/Emerge Brazilian Jiu Jitsu reserves the right to make changes to the Terms of Use. Members are notified of changes at registration and have 30 days to cancel their membership if they do not agree with the amended terms.
**19. Cancellation of Classes and Closure of Location**
- **Cancellation of classes:** We reserve the right to cancel scheduled classes at any time. If a class is canceled, we will endeavor to notify participants as soon as possible. Participants are not entitled to compensation or reimbursement for canceled classes in such cases.
- **Closure of location or business:** In the event that a location must be temporarily or permanently closed, or if the business ceases operations, all ongoing subscriptions will be automatically terminated. In such a scenario, the company will not owe any refund or any form of compensation to customers for the remaining period of their subscription.
By agreeing to these terms upon purchasing a subscription or registering for classes, you acknowledge and agree that the company has no financial obligations to you under these circumstances.
